These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("Client," "you," "your"), and Motiv8 Pilates ("Studio," "we," "us," "our"), located at [Your Full Address, Malden, MA 02148]. These Terms govern your access to and use of all services, including but not limited to studio classes, private sessions, workshops, online content, website, mobile application, and retail purchases (collectively, the "Services").

By accessing, purchasing, booking, or using any of our Services, you acknowledge that you have read, understood, and agree to be bound by all of these Terms. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND MUST DISCONTINUE USE IMMEDIATELY.

2. ELIGIBILITY

You must be at least 18 years of age to purchase Services and enter into these Terms. Individuals under 18 may participate only with a parent or legal guardian's consent and signature on all required documents. By using our Services, you represent and warrant that you meet all eligibility requirements.

3. SERVICE PURCHASES AND MEMBERSHIPS

3.1 Class Packages (Non-Membership)

  • 5-Class Package: Valid for 3 months (90 days) from the date of purchase.

  • 10-Class Package: Valid for 5 months (150 days) from the date of purchase.

  • All class packages are non-transferable, non-refundable, and may not be shared with another individual.

  • Class packages may be used for regularly scheduled group classes only, unless otherwise specified. Private sessions require separate purchase.

  • Expired classes will not be extended, refunded, reinstated, or credited under any circumstances. It is your responsibility to track your expiration dates and class usage.

3.2 Auto-Renewing Membership Plans

Motiv8 Pilates offers auto-renewing membership plans that provide a set number of classes per month, as advertised at the time of purchase (e.g., "Monthly 4-Class Membership").

  • Enrollment and Billing: By purchasing an auto-renewing membership, you authorize us to charge your payment method on file the recurring membership fee in advance on the same date each month (your "Billing Date").

  • Class Credits: Your monthly class credits are added to your account on your Billing Date. Unused credits expire at the end of each monthly billing cycle and do not roll over. We do not offer prorated refunds for unused classes.

  • Membership Freeze: You may request to freeze your membership once per calendar year for a minimum of 2 weeks and a maximum of 2 months for medical reasons or extended travel, with written notice and supporting documentation. A $15/month freeze fee applies. Your billing cycle will extend accordingly.

  • Membership Cancellation: You may cancel your auto-renewing membership by providing written notice via email to [yourstudio@email.com] at least 30 days prior to your next Billing Date. Verbal or in-person requests are not valid. Upon cancellation, your membership will remain active, and you will retain access to any unused credits until the end of the current paid period.

  • Price Changes: We reserve the right to modify membership prices with 30 days' written notice (email) to current members.

  • No Unlimited Option: Motiv8 Pilates does not offer an "unlimited classes" membership option at this time.

3.3 Private Sessions and Workshops

  • Private sessions and workshops must be paid in full at the time of booking and are subject to separate pricing.

  • Cancellation policies for private sessions and workshops may differ from group classes and will be specified at the time of purchase. Unless otherwise stated, the standard 12-hour cancellation policy applies.

4. BOOKING, CANCELLATION, AND NO-SHOW POLICY

THIS IS A MATERIAL TERM OF OUR AGREEMENT.

4.1 Booking

  • Appointments may be booked online via our website or app, or in-person.

  • Booking a class constitutes a reservation for a limited space and you agree to the cancellation policy below.

  • You may only book a class if you have an active package or membership with available credits.

4.2 Cancellation Window

  • You must cancel any scheduled class, session, or appointment at least 12 hours prior to its start time to avoid a penalty.

4.3 Late Cancellation Fee

  • Cancellations made less than 12 hours before the scheduled start time will incur a $25 Late Cancellation Fee. This fee will be automatically charged to the payment method on file and is separate from the forfeiture of your class credit.

4.4 No-Show Policy

  • Failure to attend a scheduled session without prior cancellation constitutes a "No-Show."

  • A No-Show will result in:

    1. A $25 No-Show Fee charged to the payment method on file, AND

    2. FORFEITURE OF THE CLASS CREDIT used to book the session. The credit will be permanently deducted from your account. For members, this counts as your monthly class usage.

4.5 Waitlist

  • If you join a waitlist, you are subject to the same 12-hour cancellation policy from the moment you are automatically added to the class and receive a confirmation notification (email or SMS).

5. PAYMENT TERMS AND FEES

5.1 Payment Authorization

  • You authorize Motiv8 Pilates to charge your designated payment method for all fees incurred, including but not limited to: class packages, membership fees, late fees, no-show fees, retail sales, private sessions, and workshops.

  • You agree to maintain a valid payment method on file at all times while holding an active auto-renewing membership.

5.2 Declined Payments & Late Fees

  • If a payment is declined, you will be notified and given 48 hours to update your payment information.

  • A $25 service fee may be charged for any payment that is declined or returned.

  • Accounts with overdue balances, including declined membership payments, will be suspended, preventing future bookings, until payment is received in full.

5.3 No Refunds

  • ALL SALES ARE FINAL. We do not offer refunds for class packages, memberships, private sessions, workshops, retail products, or any fees (including late and no-show fees) under any circumstances, except as required by Massachusetts law.

6. STUDIO ETIQUETTE AND CONDUCT

6.1 Health and Safety

  • You must complete and sign a separate Liability Waiver and Release Agreement before participating in any physical activity.

  • You must inform your instructor of any injuries, illnesses, or physical limitations before each class.

  • You agree to follow all posted safety rules and instructor directions.

6.2 Timeliness

  • Arrive at least 5 minutes before class. Doors may be locked at the scheduled start time.

  • Late arrivals may be denied entry for safety and to avoid disruption, which will be treated as a No-Show (Section 4.4).

6.3 Cleanliness

  • You agree to clean all equipment used with provided supplies after your session.

6.4 Personal Property

  • The Studio is not responsible for lost, stolen, or damaged personal property. Use provided storage at your own risk.

6.5 Code of Conduct

  • We reserve the right to refuse service or cancel a membership for behavior deemed inappropriate, unsafe, or disruptive to staff or other clients. In such cases, no refund will be provided for any remaining classes or membership fees.

7. INTELLECTUAL PROPERTY

All class formats, choreography, programming, manuals, digital content, and the "Motiv8 Pilates" name and logo are proprietary property of the Studio. You may not record, reproduce, distribute, or teach the content received during Services without express written permission.

8. PRIVACY POLICY

Your use of the Services is also governed by our Privacy Policy, which outlines how we collect, use, and protect your personal information. By using our Services, you consent to such processing.

9. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY MASSACHUSETTS LAW, IN NO EVENT SHALL MOTIV8 PILATES, ITS OWNERS, EMPLOYEES, OR CONTRACTORS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOST DATA, OR PERSONAL INJURY, ARISING OUT OF YOUR USE OR INABILITY TO USE THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Any dispute arising from or relating to these Terms or your use of the Services shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles. You agree to submit to the exclusive personal jurisdiction of the state and federal courts located in Middlesex County, Massachusetts.

11. MODIFICATION OF TERMS

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of material changes by posting the new Terms on our website and/or notifying you via email. Your continued use of our Services after any such changes constitutes your acceptance of the new Terms.
